TERMS AND DEFINITIONS


 

  • Nemo - Wodny Świat Dąbrowa Górnicza Sp. z o.o. referred to in these Rules and Regulations as Nemo or Site.

  • The Management Board of Nemo - Wodny Świat Dąbrowa Górnicza Sp. z o.o. referred to in these Rules and Regulations as the Management.

  • The Rules and Regulations of the Wet Area at Nemo - Wodny Świat Dąbrowa Górnicza referred to in these Rules and Regulations as the Regulations.

  • Pool Area shall mean the recreational pool along with attractions, Sports Pool and outdoor pools.

  • The Strip shall mean the electronic equivalent to the ticket type purchased designed to open and close the locker and needed to settle your account for purchased services.   

 

I. GENERAL INFORMATION

  1. Each person using the services of Nemo is required to familiarise themselves with these Regulations before entering the Wet Area including indoor and outdoor pools with attractions, sauna world, fitness area and the salt cave

  2. The Pool Area is open:

  • Monday to Friday from 7.00 a.m. to 9.45 p.m. (Sports Pool); 9.00 a.m. to 9.45 p.m. (Recreational Pool with attractions);

  • Saturdays from 9.00 a.m. to 9.45 p.m. (Sports Pool and Recreational Pool),

  • Sundays and public holidays from 9.00 a.m. to 9.45 p.m. (Sports Pool and Recreational Pool).

  1. The Sauna World is open:

  • Monday to Friday from 3.00 p.m. to 9.45 p.m.,

  • Saturdays from 10.00 a.m. to 9.45 p.m.,

  • Sundays and public holidays from 9.00 a.m. to 9.45 p.m.

  1. The Salt Cave is open:

  • Monday to Sunday from 9.00 p.m. to 7.00 p.m. (last treatment session).

  1. The Fitness Area is open:

  • Monday to Friday from 7.00 a.m. to 9.00 p.m.,

  • Saturdays from 9.00 a.m. to 9.00 p.m.,

  • Sundays and public holidays from 9.00 a.m. to 8.00 p.m.

  1. The last admission into the Pool Area and the Sauna World is at 9.00 p.m. from Monday to Saturday and at 8.00 p.m. on Sundays and public holidays. The last admission to the Fitness Area is from Monday to Saturday at 8.00 p.m. and on Sundays and public holidays at 7.00 p.m.

  2. The Pool Area and the Sauna World shall be vacated no later than 15 minutes before Nemo closing hours regardless of the time of the ticket purchase. All patrons are required to leave the site by 10.00 p.m. from Monday to Saturday and by 9.00 p.m. on Sundays and public holidays.

  3. The patrons are required to return the Strip Final and settle their accounts no later than by 10.00 from Monday to Saturday and by 9:00 p.m. on Sundays and public holidays.
     

  4. An additional fee shall be charged for each minute spent at the Site after 10.05 p.m. from Monday to Saturday and after 9.05 p.m. on Sundays and public holidays and shall, for each type of the ticket, be PLN 5. This shall apply to both regular tickets and subscription cards and other cards honoured by Nemo.

 

  1. The purchase of a day-long service shall entitle you to a single entry to the pool. Crossing the exit gate shall be deemed as the termination of the service.
     

  2. The advance payment for your stay at the Site shall be collected up-front, for the service as specified by the patron. An additional fee for a service or product purchased shall be collected at the exit at the box office.

 

  1. Nemo reserves the right to change prices and opening hours of each attraction.

 

  1. The purchase of a ticket, voucher, subscription card shall be understood as your having accepted the Regulations.

 

  1. Children under the age of 10 may stay at Nemo only under the constant supervision of adult custodians. The custodians shall be fully responsible for the children under their custody and be liable for any damage caused by them.

 

  1. The time of your stay in the Wet Area shall count from the Strip read-in at the turnstiles at the box office until it is returned to the cashier at the exit.

 

  1. Each customer exiting the Wet Area may use the time lock. The time lock (10 min.) operates only at the exit and will not extend your stay at the Site. Should you exceed your 10-minute time lock, it shall be cancelled and charged for.

 

  1. Patrons at Nemo who violate the public order and pose a threat to themselves or others, and who do not comply with the Regulations and Nemo staff instructions, shall be requested to leave the Site without the right to the admission reimbursement.

 

  1. No persons who are under the influence of alcohol, intoxicated, or under the influence of drugs or any other controlled substances shall not be allowed at Nemo.

 

  1. In justified cases, the staff shall have the right to refer the persons using the Site to a sobriety test. The refusal to submit to the sobriety test shall result in the removal from the Site.
     

  2. In the event of an accident or an injury, the Site’s owner or insurer shall have the right to refuse to compensate persons who are under the influence of alcohol or intoxicated or under the influence of any drugs or controlled substances.

 

  1. Activities at Nemo may take place only in the presence and under the supervision of certified instructors, employed or authorised by Nemo, and of lifeguards.

 

  1. Any accidents and damage must be reported immediately to Nemo’s staff.

 

  1. The use of the swimming pool changing rooms and lockers shall be mandatory. You shall change only in designated changing rooms as locker rooms are surveilled by CCTV.

 

  1. Before using the services of Nemo the patrons shall place all their belongings:
    • in a cabinet located in the locker room (lockable with the Strip)
    • valuables shall be deposited in the safe box behind the ticketing office (lockable with a key).
    The patron shall be required to properly close the locker and the safe box.

 

  1. No prams and strollers are allowed in Pool Area. Prams and strollers may be left at your own responsibility in the lobby behind the ticketing offices except for the summer period when outdoor pools are accessible. Prams and strollers may be taken into the outdoor pools area passing through the locker room for the disabled.

 

  1. Pool slippers are mandatory at Nemo. Poll slippers shall be put on in the lobby behind the ticketing offices in the "Shoe Changing Area" – bring the regular shoes with you.

 

  1. Glasses and contact lenses are worn at the risk of the wearer. In the event of breakage or cracking of glasses the person using them shall immediately inform Nemo staff about the incident.

 

  1. It is strictly forbidden at Nemo to:
    • smoke,
    • chew gum, bring and consume your own food and alcoholic beverages,
    • bring glass containers, sharp tools and other dangerous objects.
    • take in animals,
    • for any third parties to engage in any gainful occupation including the provision of swimming lessons without the consent of Nemo,
    • photograph and film, without the prior consent of the Management (except for photos and videos made exclusively for private use)
    • behave in ways that may be interpreted as inappropriate and indecent.
    In the case of closed functions and events with the prior consent of the Management, derogations may operate from the said the Regulations provisions.

 

  1. Nemo shall not be held liable for any valuables and money not deposited in the safe box and lost - Nemo does not respond.

 

  1. Premises of Nemo are monitored on a continuous basis in order to improve the safety of patrons. CCTV recordings may be the basis used to hold liable patrons who do not respect the Regulations. The Management warrants that the monitoring is carried out in a way that does not prejudice personal rights and dignity of patrons.

 

  1. The Management may, in cases justified on reasons of safety or other important reasons, may limit the use of the Site as a whole.

 

  1. The violation of these Regulations may result in violators being requested to leave Nemo without the right to reimbursement for admission ticket purchased.

 

II. POOL AREA TERMS OF USE

 

  1. Swimwear shall be worn exclusively in the Pool Area: one- or two-piece swimsuits for women and swimming trunks or shorts for men.

 

  1. Pools may be used only in the presence of lifeguards.

 

  1. Children and adults who require diapers during the use of the pools shall wear the at all times.
     

  2. Each patron shall be required to wash the whole body and disinfect their feet before entering the Pool Area.

 

  1. When using water attractions, in particular waterslides and the Wild River, one shall strictly adhere to the instructions manual and to automatic light signalling as well as to lifeguards’ instructions.

 

  1. Staff responsible for the safety of bathers: lifeguards, organised group’s guides, activities instructors, children custodians.

 

  1. The lifeguards wear T-shirts with the inscription "ratownik" (Lifeguard).

 

  1. Bathers shall strictly comply with the decisions and instructions of the lifeguard.

 

  1. All pools (except for wading/paddling pools) of more than 1.20 meter depth are designed for persons who can swim.

 

  1. Lifeguards are off-duty after 10.00 p.m. on weekdays and after 9.00 p.m. on Sundays and public holidays. Absolutely no swimming and no using of attractions apply.

 

  1. The water slides and the Wild River are higher-risk zones. Please consult he Regulations before use.

 

  1. Nemo shall not be liable for any damage to swimwear in the Pool Area for reasons independent of Nemo.

 

  1. Exiting and entering swimming pools shall be only in designated areas.

 

  • It is strictly forbidden in the Pool Area to:
     

  • create dangerous situations for yourself and other bathers,

  • run, push and throw other bathers to water,

  • climb balustrades, lifeguard stands, walls surrounding the pools, flower pots and areas and other equipment not designed for this purpose,

  • dive into water,

  • use rescue and swimming equipment for purposes other than intended for,

  • bring bags except for bags with articles for the child care and with swimming equipment,

  • consume food outside the bar,

  • throw dishes, food leftovers and other items into water,

  • bring and consume your own food and alcoholic beverages,

  • smoke including in outdoor pools,

  • destruct equipment, greenery,

  • pollute water, use soap and other chemicals in swimming pools,

  • sit and hang on track ropes for not justified reason,

  • bring and use your own diving equipment without the approval of Nemo, with the exception of ABC equipment (mask, snorkel, fins);  you must not use fins at the recreational pool,

  • initiate false alarm and make noise,

  • swim across swimming tracks,

  • make videos and photos without the consent of Nemo (except for photos and videos made for exclusively private use private),

  • in justified cases, Nemo’ staff may prohibit using your own swimming accessories and equipment supporting swimming,

  • it is not allowed to use swimming accessories and swimming supporting equipment being part of the Site’s equipment outside the recreation pool.
     

  1. Only patrons with valid tickets are allowed in the Pool Area.

  2. While in the Pool Are, each patron shall be required to wear the Strip on his/her wrist or ankle.

  3. Each patron shall take care of his/her own Strip received at the entrance. The Strip is not transferable and/or lendable to third parties.

  4. The maximum permissible total filling of the Pool Area and the Sauna World is 420 people per time unit, and 550 people per time unit in summertime. In order to sustain all safety requirements once the maximum allowable fill is reached, letting patrons enter each area shall be discontinued.

  5. In the event of any danger the lifeguard may order bathers to immediately leave swimming pools.

  6. The following acoustic signals shall apply:
    • warning signal - a series of short whistles,
    • signal to immediately leave the basin - a series of three long whistles,
    • warning -cum-announcement signalling – PA system.

  7. The right-hand traffic operates when swimming at the Sports Pool.

  8. The maximum number of swimmers at the swim-track is 6. Purchasing 6 individual tickets shall not be equivalent to booking the whole track.

  9. Anybody with visible signs that may indicate: infectious skin diseases and other infectious diseases, mycosis, HPV, erysipelas or holy fire, erythema, etc., open lesions or cuts, slowly healing wounds, lack of personal hygiene, marks on limbs of frequent intravenous injections, difficulty in breathing, balance disorder, aggressive behavior. People prone to fits or cramps or fainting (loss of consciousness) and people mentally handicapped may enter and stay on the property only with a supervisor or custodian.

  10. Individuals with aggressive behavior, violating the personal dignity of others will be removed from the Pool Area without the right to reimbursement of the purchased ticket.

  11. People with unstable health condition should use the pools and facilities with utmost care, preferably after having consulted their medical doctor. Nemo shall not be liable for any adverse health effects of such patrons staying at the Site.

  12. Any cuts, injuries and discomfort shall be reported immediately to the nearest lifeguard.

  13. Providing emergency medical aid is carried out at the dispensary in the Pool Area.

  14. Supervision over the proper use of the facilities shall be performed by lifeguards.

  15. The Pool Area must not be used by intoxicated persons or those under the influence of an intoxicant substance.

 

WATER SLIDES:

  1. The slides are an integral part of the Site and the provisions of the Regulations shall apply.

  2. Patrons using water slides do so at their own risk (slides are the attractions of an increased risk of accidents).

  3. The slides may only be used by persons in healthy condition and full functional mobility

  4. The slides must not be used by persons under the influence of alcohol, intoxicated and under the influence of any drugs and/or controlled substances.

  5. When using slides please strictly follow the instructions of lifeguards on duty.

  6. The red and yellow slides may be used independently by patrons of over 10 years of age. Children under 10 years of age may use the red and yellow slides only with a supervisor. The green slide (turbo slide) may be used by patrons over 14 years of age.

  7. Only one person may get positioned on the starting platform except for the yellow or red slides where a guardian or custodian of a child of up to 10 years of age may stand.

  8. Before sliding down make sure that you remove the goggles, prescription glasses, sunglasses, jewelry, watches and other items that could cause injury or damage to a user and/or the slide.

  9. Before sliding down be absolutely sure that water flows down the slide. Riding down without water is strictly prohibited.

  10. Observe signalling lights located above the entrance to the slide. Red indicates that it is absolutely prohibited to enter and run down the slide, and after the green light is son you shall:
    • quietly enter the starting platform,
    • bend down and do a half-step forward by going to the slide head,
    • take the correct position, i.e. sit down or lie down in the slide on your back, feet first towards the slide-down,
    • gently push off from the side walls or from the bar of the slide pipe.

  11. Throughout the entire ride down please watch the sliding surface ahead of you so that you are able to slow down to avoid bumping against your predecessor.

  12. Once the ride is over, immediately leave the slow-down pool.

  13. After leaving the slow-down pool please immediately report any defects you might have observed or any bumps into other sliders to the lifeguard.

  14. You must not stop while riding down the slide.

  15. Those who do not abide by these Regulations may be asked to leave the water attractions, and in the case of gross violation of the Regulations such persons may be implored to leave the Site without the right to reimbursement for the admission ticket purchased.

 

JACUZZI:

  1. Jacuzzi is an integral part of the Site and the provisions of the Regulations shall apply.

  2. Each and every Jacuzzi user shall get familiar with the separate Jacuzzi Regulations.

  3. Using Jacuzzi shall be at your own risk.

  4. Jacuzzi is available for all users of the Site except for:
    • children under 2 years of age,
    • people under 100 cm of height,
    • group members without their guide

  5. Persons with cardiovascular, respiratory, neurological and gastric conditions and other diseases as well as pregnant women should use the Jacuzzi with great caution and after prior medical consultation.

  6. Children under 10 years of age may enjoy the Jacuzzi only under the constant supervision of adults and custodians.

  7. Exercise extreme caution when entering or leaving the Jacuzzi.

  8. Persons coming out of the Jacuzzi shall have the right of way.

  9. Maximum of 6 people may stay in the Jacuzzi at one time.

  10. For safety reasons it is forbidden:
    • to use the Jacuzzi when the aeration system is off,
    • to use the bath when the access is closed off with a chain, rope, barrier or in any other visible way,
    • to push others into the bath,
    • to bring into the bathtub any objects and chemicals, e.g. soap, essential oils, bath salts, etc.,
    • to stay in the bath in a standing position, immerse the head and face, dive and sit on the edge of the bath basin,
    • pour water out of the tub,
    • dive or jump into the bathtub.

  11. Lifeguards shall supervise the compliance with the proper use of the attraction.

  12. Those who do not abide by these Regulations may be asked to leave the water attractions, and in the case of gross violation of the Regulations such persons may be implored to leave the Site without the right to reimbursement for the admission ticket purchased.

 

 

WILD RIVER:

  1. The Wild River is an integral part of the Site and the provisions of the Regulations shall apply.

  2. Each and every Wild River user shall get familiar with the separate Wild River Regulations

  3. The Wild River is available only for patrons able to swim with a minimum height of 140 cm.

  4. Children under 10 years of age may enjoy the Wild River only under the constant supervision of adults and custodians.

  5. When using the Wild River, you must not:
    • dive below the water surface,
    • dive,
    • halt,
    • move in the opposite direction to the current of the Wild River flow.

  6. Lifeguards shall supervise the compliance with the proper use of the attractions.

  7. Those who do not abide by these Regulations may be asked to leave the water attractions, and in the case of gross violation of the Regulations such persons may be implored to leave the Site without the right to reimbursement for the admission ticket purchased.

 

 

ORGANISED GROUPS:

  1. An organised group shall mean a group of persons using the services of Nemo, which are under the supervision of a custodian, guardian, leader, teacher, instructor, coach or any other authorised person (“Group Leader”).

  2. These Regulations shall apply in conjunction with the General Rules and Regulations of Nemo.

  3. Before an organised group enters the swimming pool, the Group Leader shall fill in the registration form for the group and give it to the Rescue Shift Coordinator immediately after entering the Pool Area. This shall mean his/her confirmation of the Regulations in force at Nemo.

  4. Before the first entry of the group at the Site safety instructions shall be provided by the lifeguard or other authorized staff on basic rules of behavior at the Site.

  5. To one Group Leader, no more than:

  • 30 adult patrons,

  • 15 minor participants or adult students/schoolers,

  • 5 pre-school participants

    may be attached to.

  1. The number of disabled persons per one Group Leader as determined and approved by the Management shall depend on the type of disability and the health condition of charges/wards or those under his/her supervision.

  2. During the Group's stay at Nemo, the Group Leaders shall be required to ensure that all Group members abide by the Regulations, behave in a safe, quiet and cultivated manner, do not make noise and destroy the equipment and property located on the Site.

  3. The Group Leaders shall enter Nemo free of charge (1 Group Leader for every 10 people).

  4. The Group Leader shall be responsible for the Group’s arrival at least 15 minutes before agreed time for the start of activities.

  5. The Group Leader shall represent the activities arranger and shall be required to exercise proper care, supervision and security entrusted to his/her group of people.

  6. Organised groups without their Group Leader shall not be allowed to enter and stay at Nemo.

  7. The Group Leader must not coerce participants to use attractions of Nemo.

  8. The Group Leader and Group members shall be required to obey the instructions of lifeguards and staff of Nemo.

  9. The duties of the Group Leader shall include:
     

  • bringing in the Group to the main lobby of Nemo and pointing to the waiting space before the entry to the locker room so that the use of cash stands is not hindered to individual customers,

  • settling all cash office formalities connected with the group entry, picking up Strips for the Group members,

  • keeping information about the state of health, and of physical and mental condition of the Group members and their swimming skills and, based on that knowledge, in consultation with the lifeguards coordinator, developing the Nemo stay programme for the Group to use water attractions,

  • providing participants with the Strips and giving instruction to those under his/her supervision about the use of lockers,

  • having a commitment signed to strictly comply with the Regulations of Nemo, providing the name and address of the Site, the name/-s of the guardian/-s and the size of the group (registration form),

  • bringing in the Group into the locker room and ensuring that they change into bathing suits, having clothes put in lockers and cabinets properly locked,

  • bringing the Group out of the locker room to the shower rooms and toilets,

  • pointing to the toilets and to drawing attention to the obligation to use them during their stay at the Site,

  • making sure that the participants have correct type, complete and hygienic swimsuits,

  • bringing the Group out of the shower rooms to the Pool Area and making sure that participants thoroughly wash their bodies and feet using washing/cleaning agents before using the Pool Area,

  • notifying the Lifeguards Coordinator that the Group has been brought in to the Pool Area in order to determine the terms of use of the attractions,

  • ordering the Group assembly and checking the Group numbers,

  • continuously controlling the behavior of the Group participants throughout their stay at the Pool Area and taking actions as and when needed to maintain security and order,

  • getting, before the end of the stay, those under the supervision deposited sports, swimming and life-saving equipment in a designated place,

  • after the expiry of the allocated time, ordering the assembly, verifying the numbers of the Group and taking the Group from the Pool Area to the showers and toilets,

  • notifying the termination of activities to the lifeguard and taking  the Group from Pool Area,

  • making sure that the Group members wash their whole body after leaving the Pool Area,

  • making sure that the Group members empty their lockers and take all their personal belongings with them,

  • collecting all the Group members’ Strips and settling them at Nemo’s cash offices according to the applicable price list of services at the time being,

  • taking the Group to Nemo’s main lobby.

  1. The Group Leader shall be responsible for reporting any accident occurring during the time of the Group’s stay at the Site to the Lifeguard and/or the staff and for confirming a relevant entry into the Lifeguards Log.

  2. The Group Leader shall be responsible for any damage caused by the Group during their stay at Nemo and any accidents caused by failure by the Group members to comply with regulations in force at Nemo.

  3. The Group Leader shall exercise a constant supervision of the Group and shall be responsible for the Group’s safety at: the locker room, showers and the Pool Area.

  4. The Group Leaders shall be required to change into a swimsuit or sports apparel and remain throughout the stay of the Group in the Pool Area with the Group and control their behaviour.

  5. The Group Leader shall, during the water activities, be in such a place close to the water table so as to see, and be seen by, all participants.

  6. The duties and obligations of the Group member shall include:

  • navigating the Nemo complex together with the group,

  • changing, in compliance with the Regulations, into a clean swimsuit or bathsuit, putting clothes in the lockers and locking them properly,

  • thoroughly washing the body and feet using washing/cleaning agents before using attractions,

  • participating in the assembly starting activities,

  • strictly respecting the commands of lifeguards, staff of Nemo and Group Leaders,

  • observing the rigorous instructions:

    1. not to initiate and engage in any threatening situations to your own safety and the safety of other persons using Nemo,

    2. not to run, throw and push other participants into the water and not to initiate any false alarms,

    3. not to cross areas designated for the Group to bathe and not to leave the Pool Area without notifying the Group Leader,

    4. not to jump and dive into the water, use water facilities and attractions without the express permission of the Group Leader,

    5. not to swim in glasses and jewelry on (watches, rings and wedding rings, bracelets, straps, laces, chains, earrings, hair ornaments, etc.),

    6. not to use diving masks and other equipment without permission of the lifeguard or the Group Leader,

  • signalling to the Group Leader all situations that might lead to an accident including your own discomfort and inability to perform activities or use water attractions,

  • reporting to the Group Leader each case of injury or lesion sustained during activities, attending the assembly ending the activities,

  • after completing the activities, returning, in a designated place, sports, swimming or rescue and life-saving equipment, and - after leaving the Pool Area - thoroughly washing the whole body.

 

  1. In the event of serious deficiencies in terms of compliance with the Regulations in force at Nemo by the organised group – the lifeguard an-or staff shall have the right to prohibit the Group from further use of the Site.

 

VI. LIABILITY AND PENALTIES

  1. An indemnity at 100% of the value of equipment shall be charged for the destruction or loss of a piece of the facility equipment.

  2. Nemo shall not be responsible for items lost or left behind at the Site.

  3. Items left behind at the Site and found by the staff shall be deposited in baskets behind cash offices for 3 weeks.

  4. Each patron shall be responsible for his/her Strip which they received when buying an admission ticket to Nemo (from entering the pool until its return to the cashier). Any accidental replacement of Strips that may happen through the patron’s inattention shall not be accepted during the settlement of the Strip at the exit. The patron returning the Strip shall be obligated to pay any additional charges arising from the incompatibility of the topped-up ticket Strip or any additional services, e.g. catering.

  5. The loss of, or damage to, the Strip, preventing the normal functioning thereof, shall entail a charge in the amount of PLN 100.

  6. A charge of PLN 150 shall be imposed for the lost safe-box key.

  7. Nemo shall not be held responsible for any accidents caused by non-observance of the Regulations, instructions and commands of the authorised personnel. The Regulations shall apply to all users of the Site. With the entry into the Site, the user shall be required to observe the provisions of these Regulations and all other safety instructions and correct operating manuals of the Site.
